1. General

These terms and conditions apply to all rental agreements between the lessor and the lessee. By placing a booking, the lessee fully accepts these terms without reservation.

2. Booking and Confirmation

A booking is only final after written confirmation by e-mail from the lessor. The lessor reserves the right to refuse a booking without giving reasons. The lessee receives a unique reference for their reservation.

3. Rental Period and Collection

The rental period begins on the agreed start date and ends on the agreed end date. The machine must be returned or ready for collection by 17:00 on the end date. Late returns will be charged as an additional rental day.

4. Condition of the Machine

The lessee undertakes to:

• return the machine in a clean condition (internally and externally cleaned);
• return the machine in the same condition as received;
• use the machine only for its intended purpose;
• not sublet or lend the machine to third parties;
• protect the machine against damage, theft or loss.

5. Damage and Liability

Upon return, the machine will be inspected. Any damage, deterioration or contamination not present at the start of the rental will be deducted from the deposit. If repair costs exceed the deposit, the remaining amount will be invoiced to the lessee. The lessee is liable for:

• all damage caused during the rental period;
• theft or loss of the machine or accessories;
• damage due to improper use or non-compliance with the user manual.

6. Security Deposit

A deposit is required for every rental. The deposit will be refunded within 5 working days after return of the machine, provided there is no damage or additional costs. The lessor has the right to withhold all or part of the deposit in case of damage, loss or late return.

7. Cancellation

Cancellation must be communicated in writing. The following rules apply:

• More than 48 hours before start date: free cancellation;
• Between 24 and 48 hours before start date: 50% of the rental price will be charged;
• Less than 24 hours before start date or no-show: 100% of the rental price will be charged.

8. Transport and Delivery

For delivery to address, transport costs are calculated in advance based on distance. The lessee must be present at the given address at the agreed time. In case of the lessee's absence, the round-trip transport costs will be charged.

9. Payment

The rental price and deposit are due before or upon collection / delivery of the machine, unless otherwise agreed in writing. Invoices must be paid within the period stated on the invoice. Late payment automatically incurs interest of 8% per year, plus a fixed penalty of 10% with a minimum of €50.

10. Force Majeure

The lessor is not liable for delays or failure to fulfil obligations due to force majeure (fire, flood, strike, pandemic, etc.). In such cases, the lessee is entitled to rescheduling or free cancellation.

11. Governing Law and Jurisdiction

All agreements are governed by Belgian law. Any disputes fall under the exclusive jurisdiction of the courts of the district of Tongeren.
